Terms of Use

Effective Date: March 18, 2026

These Terms of Use ("Terms") govern your access to and use of the HousesGate website and platform located at housesgate.com (the "Site"), operated by HousesGate Inc. ("HousesGate," "we," "us," or "our"), a licensed real estate brokerage in the Province of Ontario, Canada. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, you must not use the Site.

1. Site Access and Account Requirements

Certain features of the Site, including saved searches, listing alerts, and access to Virtual Office Website ("VOW") data, require you to create an account. When you register you agree to:

  • Provide accurate, current, and complete information during registration and keep it up to date.
  • Be at least 18 years of age or the age of majority in your province or territory of residence.
  • Acknowledge and accept the VOW Terms of Use presented during registration, which form part of these Terms.
  • Maintain the confidentiality of your login credentials (see Section 6 — User Obligations).

We reserve the right to refuse registration, suspend, or terminate any account at our sole discretion.

2. VOW Data — Personal, Non-Commercial Use Only

The Site may display listing data provided under the rules of the Toronto Regional Real Estate Board ("TRREB") and the Canadian Real Estate Association ("CREA") through a Virtual Office Website (VOW) arrangement. By accessing VOW data you acknowledge and agree that:

  • All listing information is provided exclusively for your personal, non-commercial use and may not be used for any purpose other than identifying real estate properties you may be interested in purchasing or leasing.
  • You will not access VOW data unless you have a bona fide interest in the purchase, sale, or lease of real estate.
  • The listing data remains the property of TRREB, its member brokerages, and/or the listing agents, and is protected by copyright.
  • You will not reproduce, redistribute, retransmit, or display VOW listing data in whole or in part by any means, including but not limited to scraping, framing, deep-linking, or screen-capture technology.

3. Prohibited Commercial Use and Redistribution

You expressly agree that you will NOT:

  • Use listing data, market statistics, or any content from the Site for any commercial purpose, including but not limited to competitive analysis, data aggregation, lead generation for third parties, or resale.
  • Provide, sell, license, or otherwise make available any data obtained from the Site to any third party.
  • Use automated systems, bots, crawlers, or scrapers to access the Site or extract data without prior written consent from HousesGate.
  • Circumvent, disable, or otherwise interfere with any security or access-control features of the Site.

Violation of this section may result in immediate account termination and may give rise to civil or criminal liability.

4. Data Accuracy Disclaimers

Listing data displayed on the Site is obtained from TRREB and other third-party sources and is believed to be reliable but is not guaranteed. Specifically:

  • HousesGate does not warrant or guarantee the accuracy, completeness, reliability, or timeliness of any listing data, including but not limited to property descriptions, pricing, lot sizes, square footage, photos, or availability.
  • Information may be subject to errors, omissions, changes in price, prior sale, lease, or withdrawal without notice.
  • You should independently verify all information before making any real estate decisions and should not rely solely on the information provided on this Site.
  • Data provided through TRREB's MLS® System may not reflect the entire real estate market in any given area.

5. Intellectual Property

All content on the Site — including text, graphics, logos, icons, images, software, and data compilations — is the property of HousesGate or its content suppliers and is protected by Canadian and international intellectual property laws.

The trademarks MLS®, Multiple Listing Service®, and associated logos are owned by the Canadian Real Estate Association (CREA) and identify the quality of services provided by real estate professionals who are members of CREA. REALTOR® is a trademark owned by CREA and used to identify real estate professionals who are members of CREA. TRREB® is a trademark of the Toronto Regional Real Estate Board.

Nothing on the Site grants you any licence or right to use any trademark, logo, or branding displayed on the Site without the prior written consent of the respective owner.

6. User Obligations

As a registered user of the Site, you agree to:

  • Keep your login credentials confidential and not share your username or password with any other person.
  • Change your password at least once every ninety (90) days, as required by VOW compliance rules.
  • Notify HousesGate immediately at [email protected] if you become aware of any unauthorized use of your account or any breach of security.
  • Accept responsibility for all activity that occurs under your account.
  • Not create multiple accounts, impersonate another person, or provide false information.

HousesGate may, at its discretion, require you to update your credentials or re-confirm your VOW consent periodically to maintain compliance.

7. Cashback Program Disclaimer

HousesGate may offer a cashback or commission rebate program to eligible buyers (the "Cashback Program"). Any cashback amounts displayed on the Site are estimates only and are subject to:

  • Review and final approval by the brokerage and the managing broker of record.
  • The actual commission offered by the listing brokerage on the applicable transaction.
  • Successful completion and closing of the real estate transaction.
  • Applicable taxes, fees, and any regulatory requirements.
  • The terms and conditions of the Cashback Program as published separately and amended from time to time.

Cashback estimates do not constitute an offer, guarantee, or promise of payment. HousesGate reserves the right to modify, suspend, or discontinue the Cashback Program at any time without prior notice.

8. Termination and Account Suspension

HousesGate may, in its sole discretion and without prior notice, suspend or terminate your account and access to the Site for any reason, including but not limited to:

  • Breach of these Terms or any applicable VOW agreement.
  • Suspected fraudulent, abusive, or unlawful activity.
  • Failure to comply with credential security requirements (Section 6).
  • Requests from law enforcement or government agencies.
  • Discontinuation or material modification of the Site or any service offered thereon.

You may terminate your account at any time by contacting us at [email protected]. Termination does not relieve you of obligations incurred prior to termination. Certain provisions of these Terms, including Sections 4, 5, 9, and 10, survive termination.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND ALL CONTENT, DATA, SERVICES, AND FEATURES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IN NO EVENT SHALL HOUSESGATE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:

  • Your use of or inability to use the Site.
  • Any errors, omissions, or inaccuracies in listing data or other content.
  • Unauthorized access to or alteration of your transmissions or data.
  • Any reliance on cashback estimates or other financial projections displayed on the Site.
  • Any other matter relating to the Site.

HousesGate's total aggregate liability to you for all claims arising out of or relating to these Terms or your use of the Site shall not exceed one hundred Canadian dollars (CAD $100.00).

10. Governing Law

These Terms and any disputes arising out of or relating to these Terms or the Site shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.

You irrevocably submit to the exclusive jurisdiction of the courts of the Province of Ontario, located in the City of Toronto, for the resolution of any disputes arising out of or relating to these Terms or the Site.

11. Changes to These Terms

HousesGate reserves the right to update or modify these Terms at any time. When we make changes, we will update the "Effective Date" at the top of this page. Your continued use of the Site after such changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
